1. Introduction

The NCAA Fund (“we,” “us,” “our”) provides financial assistance for families and parents of student-athletes traveling to support NCAA competitions or events. By applying for or receiving financial support from the NCAA Fund, you (“Applicant”) agree to the following Terms and Conditions. If you do not agree to these terms, you must not apply for or accept assistance.

2. Eligibility Requirements

To be eligible for financial assistance from the NCAA Fund, you must meet the following criteria:

  • Applicant must be a legal guardian or parent of a current NCAA student-athlete enrolled at a Division I, II, or III institution. The Applicant’s travel must be directly related to attending their child’s NCAA-sanctioned events (e.g., games, competitions, or related activities).
  • Proof of Financial Need: Applicants must provide evidence of financial need, such as recent tax returns, income verification, or similar documents.
  • No previous violation of Terms: Any applicant found misusing funds or providing fraudulent information will be disqualified from future support.

3. Application Process

  • Submission: Applicants must complete the online application form, including detailed travel plans, dates, and estimated costs.
  • Documentation: Applications must include documentation of the student-athlete's current status and relationship to the Applicant.
  • Review: Applications will be reviewed within [X] business days by the NCAA Fund’s internal review committee.
  • Decision: Approved applicants will receive notification via email, and funds will be disbursed via direct deposit or check.

4. Approved Expenses

To be eligible for financial assistance from the NCAA Fund, you must meet the following criteria:

  • Transportation: Flights, trains, buses, rental vehicles, and gas expenses directly related to travel to and from NCAA events.
  • Lodging: Standard hotel rooms or equivalent accommodations. Luxury or premium accommodations are not eligible.
  • Meals: Per diem expenses for meals during travel.
  • Non-covered expenses include, but are not limited to: Personal entertainment or luxury accommodations. Expenses unrelated to the NCAA event (e.g., sightseeing, recreational activities). Travel insurance or non-necessary insurance premiums.

5. Disbursement of Funds

Upon approval, funds will be disbursed directly to the Applicant or, in certain cases, may be prepaid by the NCAA Fund. Disbursement may take up to [X] days from the date of approval. The amount approved is final, and no additional requests for the same event will be considered.

6. Use of Funds

Funds received from the NCAA Fund must be used solely for the approved Name, Image, and Likeness related contracts. The misuse of funds, such as using them for personal or unauthorized expenses, may result in immediate repayment of the disbursed amount. Disqualification from future assistance. 7. Misrepresentation and Fraud

Applicants are expected to provide truthful and accurate information. Any intentional misrepresentation, submission of falsified documents, or fraudulent activity will result in the immediate rejection of the application and potential legal consequences.

8. Tax Liability

The NCAA Fund does not provide tax advice. Applicants are responsible for determining the tax consequences of receiving financial assistance. We recommend consulting with a tax professional for any questions regarding potential tax liabilities.

9. Non-Endorsement Clause

The NCAA Fund is an independent organization that operates without affiliation or endorsement from the National Collegiate Athletic Association (NCAA) or its member schools. Any references to NCAA events or institutions are for descriptive purposes only. The NCAA and its member schools are not responsible for, nor do they endorse, any actions taken by the NCAA Fund.

10. Amendments and Termination

The NCAA Fund reserves the right to amend these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the official website. The NCAA Fund may also terminate the availability of financial assistance at any time, for any reason, without notice.

11. Dispute Resolution

Any disputes arising from the application or use of funds must be addressed through direct communication with the NCAA Fund. If a resolution cannot be achieved, disputes will be settled through binding arbitration in [Location], governed by the laws of the state of [Insert State].

12. Limitation of Liability

The NCAA Fund is not liable for any indirect, incidental, or consequential damages resulting from the use or misuse of funds. These Terms and Conditions are governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of laws principles.

By applying for financial assistance from the NCAA Fund, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
